How it works
- The reserved portion (iryūbun) is the minimum share of an estate guaranteed to certain heirs — the spouse, children, and lineal ascendants. If a will or lifetime gifts leave them less, they can claim the shortfall in money (a reserved-portion infringement claim). Siblings have no reserved portion.
- The base estate for the calculation = estate at the time of death + certain lifetime gifts (as a rule, gifts to non-heirs within 1 year, and special benefits to heirs generally within 10 years) − estate debts. Enter this total in the tool.
- The total reserved portion is 1/3 of the base estate when only lineal ascendants are heirs, and 1/2 in all other cases (when a spouse or children are included).
- Each heir's individual reserved portion = total reserved portion × that heir's statutory share. For example, with a spouse and two children, the spouse gets 1/2 × 1/2 = 1/4 and each child gets 1/2 × 1/4 = 1/8.
- Reserved-portion infringement = your individual reserved portion − the amount you actually received (bequest, gift, or inheritance). If you received at least your reserved portion, there is no infringement. Amounts are rounded down to the nearest unit.
- This tool simplifies special cases such as inheritance by representation, half-blood siblings, and clawback of special benefits or individual debt allocation, so results are estimates only. Actual amounts depend on asset valuation, the scope of gifts, and debts. A reserved-portion infringement claim is also time-barred (as a rule, 1 year from learning of the inheritance and the infringement), so confirm exact figures and procedures with a lawyer.
